Terms of Service

1. Acceptance of Terms

These Terms of Service apply to PropDime, including our website, web application, content, data tools, features, and related services (collectively, the “Service”). In these Terms, “PropDime,” “we,” “us,” and “our” refer to the operator of the PropDime service.

By browsing, registering for, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use PropDime.

2. Eligibility and Responsible Use

You must be at least 18 years old, or the age of majority where you live, whichever is higher, to use the Service. Some third-party sportsbooks, fantasy sports platforms, or promotions may require you to be 21 or older or meet other eligibility requirements.

PropDime does not accept wagers, operate a sportsbook, set betting lines, provide gambling services, or guarantee winnings. You are responsible for determining whether sports betting, fantasy sports, or related activity is legal in your jurisdiction and for complying with all applicable laws. If you choose to place a wager or enter a paid contest through a third party, only use amounts you can afford to lose.

3. Description of the Service

PropDime provides sports research tools, player prop information, historical performance data, odds-related content, betting market information, projections, filters, dashboards, articles, and related materials. The Service is intended for informational, educational, research, and entertainment purposes.

Sports data, odds, statistics, projections, injuries, schedules, and other information may be supplied by third parties or generated from third-party sources. We try to make the Service useful and timely, but data can be delayed, incomplete, inaccurate, changed, unavailable, or affected by human or technical error. Nothing on PropDime is financial, legal, gambling, or investment advice.

4. Account Registration and Security

4.1 Account Information

You agree to provide accurate, current, and complete account, billing, and contact information and to keep that information updated. We may require you to update your information or change your username or credentials where reasonably necessary.

4.2 Account Security

You are responsible for maintaining the confidentiality of your username, password, and account access. Accounts are for individual use and may not be shared, sold, rented, transferred, or made available to others. You are responsible for activity that occurs through your account.

4.3 Unauthorized Access

You agree to notify us promptly if you believe your account has been compromised or used without authorization. We may suspend, restrict, or terminate access if we believe an account is being misused or presents a security risk.

5. Subscriptions, Payments, and Cancellations

Some portions of the Service may require a paid subscription or other purchase. Fees, billing cycles, trial periods, included features, and renewal terms will be shown at checkout or in the applicable plan details. Unless otherwise stated, subscription fees are billed in advance and renew automatically until canceled.

You authorize us and our payment processors to charge the payment method you provide for applicable fees, taxes, renewals, and outstanding amounts. You are responsible for keeping billing and payment information accurate and current.

You may cancel a subscription at any time through the available account settings or by contacting support. Unless required by law or expressly stated otherwise, payments are nonrefundable, and we do not provide refunds or credits for partially used billing periods. If you cancel, you may continue to have access through the end of the current paid billing period.

We may change prices, features, plans, or billing terms from time to time. If a change materially affects an existing subscription, we will provide notice where reasonably appropriate.

6. User Conduct and Restrictions

You agree not to:

  • Use the Service for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose.
  • Use the Service if doing so would violate laws or rules that apply to you, including gambling, fantasy sports, consumer protection, or data use rules.
  • Attempt to access accounts, systems, data, APIs, infrastructure, or features without permission.
  • Probe, scan, test, overload, disrupt, interfere with, or compromise the security or operation of the Service.
  • Use bots, scrapers, crawlers, scripts, or automated tools except where expressly permitted by us in writing.
  • Copy, resell, redistribute, sublicense, publish, frame, mirror, or commercially exploit the Service or its content without permission.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying systems from the Service.
  • Share, sell, rent, transfer, or otherwise provide your account access to another person.
  • Impersonate another person or entity, misrepresent affiliation, or manipulate identifiers to hide the origin of activity.
  • Upload or transmit malware, harmful code, spam, or other disruptive materials.

7. Content and Intellectual Property

The Service, including software, design, interfaces, logos, trademarks, text, graphics, charts, tools, filters, reports, compilations, arrangements, and other materials, is owned by PropDime or its licensors and is protected by intellectual property and proprietary rights laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own informational and research purposes. You do not acquire ownership rights in the Service or any PropDime materials by using, downloading, or viewing them.

8. Feedback

If you send us feedback, ideas, suggestions, questions, comments, feature requests, or similar information about PropDime, you grant us a worldwide, royalty-free, transferable, sublicensable, perpetual, irrevocable license to use and incorporate that feedback into the Service or other products without restriction or compensation to you. This does not give us ownership of personal information handled under our Privacy Policy.

9. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you acknowledge that internet transmissions are never completely private or secure and that information sent through the Service may be accessed, intercepted, delayed, corrupted, or unavailable despite security measures.

10. Third-Party Content, Links, and Services

The Service may display, link to, summarize, integrate with, or otherwise reference third-party content, services, websites, sportsbooks, fantasy sports platforms, promotions, markets, odds, sports data providers, payment processors, analytics tools, and other resources. We are not responsible for third-party content, practices, terms, privacy policies, availability, accuracy, delivery, eligibility rules, bonuses, promotions, or transactions.

Access to third-party content does not imply endorsement, sponsorship, affiliation, or responsibility by PropDime. You are responsible for reviewing and complying with any third-party terms that apply to you.

11. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, availability, reliability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not guarantee that any odds, stats, projections, picks, rankings, trends, reports, alerts, or other information will be accurate, complete, current, profitable, available, or suitable for your purposes. Any sports betting, fantasy sports, or related activity is inherently risky and is undertaken solely at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, PropDime and its owners, affiliates, employees, contractors, licensors, suppliers, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, reliance, lost profit, lost data, business interruption, betting loss, contest loss, or similar damages arising from or related to the Service or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising from or related to the Service or these Terms will not exceed the amount you paid to PropDime for the Service during the 12 months before the event giving rise to the claim, or $100 if you have not paid us during that period.

13. Indemnification

You agree to defend, indemnify, and hold harmless PropDime and its owners, affiliates, employees, contractors, licensors, suppliers, and service providers from and against claims, losses, liabilities, damages, settlements, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your violation of these Terms, your violation of applicable law, your account activity, or your infringement or alleged infringement of third-party rights.

14. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time if we believe you violated these Terms, created risk for PropDime or others, used the Service unlawfully or abusively, or otherwise misused the Service. We may also modify, discontinue, or stop offering any portion of the Service at any time.

15. Governing Law and Disputes

Unless a specific law requires otherwise, these Terms are governed by applicable laws of the United States, without regard to conflict-of-law principles. Any dispute must be brought individually and not as a class, consolidated, representative, or private attorney general action, to the fullest extent permitted by law.

16. Changes to These Terms

We may update, change, or replace these Terms from time to time by posting an updated version on this page. It is your responsibility to review the Terms periodically. Continued use of the Service after changes are posted means you accept the updated Terms.

17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. We may assign our rights and obligations under these Terms as part of operating, transferring, or reorganizing the Service. You may not assign your rights or obligations without our prior written consent.
